AN ACT to amend Tennessee Annotated Code relative to public school buildings.

BE IT ENACTED BY THE 2008 TENNESSEE 4-H CONGRESS:

      Section 1: This act shall be known as the hidden hall cameras for public school buildings.

     Section 2: This act shall ensure a safe learning environment for all Tennessee students enrolled in public schools.

     Section 3: According to data published by the National Center for Education Statistics, theft, drugs and weapons continue to pose problems in schools. During the 2005-2006 school year, 86 percent of public schools reported that at least one violent crime, theft or other crime occurred at their school.

     Section 4: This act shall require the installment of hidden video cameras in every hall and parking lot in public school buildings by the beginning of the 2008-2009 school year. Video tapes shall be labeled and saved for two months before being reused.

     Section 5: This act shall respect student privacy by permitting video tape surveillance only by the Tennessee Department of Education and Tennessee Department of Safety.

     Section 6: Funding for this act shall be provided by the Tennessee Department of Education.

     Section 7: This shall be enforced with annual school surveys by the Tennessee Department of Education.

     Section 8: Failure to comply will result in:

(A) 1st offense: $100 fine to public school per hall and parking lot not videotaped.
(B) 2nd offense: $200 fine to public school per hall and parking lot not videotaped.
(C) 3rd offense: $2,000 fine to public school superintendent and one (1) week suspension without pay.

     Section 9: All laws in conflict with this act are hereby repealed.

     Section 10: This act shall become effective upon passage by the legislature and approval by the Governor or upon its otherwise becoming a law.
