to amend Tennessee Annotated
Code relative to Tennessee student health and nutrition in public schools.

BE IT ENACTED BY THE 2008 STATE 4-H CONGRESS:
Section 1:
This act shall be known as Healthy Snack and Drink Machines in Tennessee Public Schools Act.
Section 2: According to data published by the Tennessee Department of Health, the 2003 Tennessee Youth Risk Behavioral Survey found 15 percent of Tennessee’s high school students are overweight. The national average is 13.5 percent.
Section 3: This act shall ensure that students in Tennessee public high schools have the opportunity to make healthier choices in the purchase of snacks and drinks from vending machines within schools.
Section 4: This act shall permit students to purchase healthy snacks before school, during lunch period and after school.
Section 5: This act shall require all drinks and snacks be consumed without distraction to teachers and their instructional time.
Section 6: This act shall require vending machines to only make available snacks which are low fat, low sugar and low sodium. All drinks must be at least 75% fruit juice, no sugar beverages or water.
Section 7: The funding from the machines may go to public education funding, with 60% going to the state and 40% to the school.
Section 8: All laws in conflict with this act are hereby repealed.
Section 9: This act shall become effective upon passage by the legislature and approval by the Governor or upon its otherwise becoming a law.
